State Responsibility for Ensuring the Availability of International Treaties at the National Level

ABSTRACT:

This paper addresses issues related to ensuring the availability of texts of international treaties under national law, refers to the current problems in this area, which often have historical origins, and points to possible solutions to remedy existing deficiencies. The main shortcomings referred to here are cases where an international treaty binding on the Czech Republic is not published at all, and situations where an international treaty is formally promulgated but its text is not published at the same time. Criticism also focuses on the absence of the
publication of authentic foreign language texts of treaties before 2000, and problems with the inaccurate or incomplete official translations of international treaties. Finally, it also covers the duplicate promulgation of mixed treaties within the European Union. Specific examples are cited in all areas of discussion. In the article, the author infers state responsibility for ensuring the availability of the texts of international treaties binding upon the state in its territory, including possible compensation obligations.

JUDr. Jan Kněžínek, Ph.D. (* 1979) is a graduate of the Faculty of Law of Charles University in Prague, where he also completed his postgraduate studies. He currently serves as Vice Director of the Government Legislative Department of the Office of the Government of the Czech Republic. He is the co-author of several specialised publications and the author of numerous articles and essays in the area of public law, which were mainly published in specialised journals and magazines.
